Terms of Service

1. Who we are

PastWP is a brand and service line of BestSecurity ApS, CVR 38821148, Denmark ("BestSecurity", "we", "us"). When you buy a PastWP package, your contract is with BestSecurity ApS. Contact: hello@pastwp.com [confirm].

2. What we deliver

We build, launch and maintain websites and related digital services under three packages: Move, Grow and Lead. The scope of each package is the one shown on pastwp.com at the time you order, or in your written offer if it differs. Anything not listed there is not included.

Compliance documentation (FAKTIVE Start) is delivered by BestSecurity ApS through FAKTIVE. It is an add-on on Move and Grow and included in Lead. FAKTIVE generates documentation; neither BestSecurity nor its partners can guarantee legal compliance. The legal responsibility for compliance rests with your company's management.

3. Your material and access

You give us access to the content, accounts and systems we need to do the work (domain, DNS, current site, brand assets, analytics). You confirm that you own or are licensed to use everything you give us. You remain the owner of your content and your domain at all times.

4. Ownership of the delivered site

When the build invoice is paid, you own the site's content, design and configuration for your own use. Code, components and tooling that we reuse across customers remain ours; you get a non-exclusive, perpetual licence to keep using them in your site. Third-party software keeps its own licence.

5. Hosting, security and uptime

Sites are hosted on EU infrastructure. We keep the platform patched, monitored and backed up. We do not promise a specific uptime percentage unless it is written in your offer. We are not responsible for downtime caused by your domain registrar, your DNS, third-party services you have chosen, or force majeure.

Backups are kept for the period stated in your package description. Restore requests are handled as part of the ongoing service.

6. Subscription, payment and price

Packages are billed as a one-off build fee plus a monthly or yearly subscription, as shown at order time. Prices are excluding VAT. Invoices are due [14] days from invoice date. If an invoice is more than [30] days overdue we may suspend the service after written notice.

We may change subscription prices with [3] months' written notice. The change applies from the next renewal after the notice period.

7. Term and termination

The subscription runs from launch and renews automatically. Either party can terminate with [1] month's written notice to the end of a month [or the end of the current subscription period, if yearly]. On termination we export your content and hand over your domain within 14 days. Hosting stops at the end of the notice period.

We may terminate immediately if you use the service for illegal content, malware distribution, spam or attacks on third parties.

8. Changes and ongoing work

Work included in "keep moving" (updates, optimisation, AI SEO and visibility work) is done at the pace described in your package. Requests outside the package are quoted separately and only started after your written approval.

9. Personal data

For personal data on your site (customer forms, bookings, tracking) we act as your data processor under the Data Processing Agreement, which is part of these terms. For pastwp.com visitors we are the data controller; see the Privacy Policy.

10. Liability

Our total liability under a contract is limited to the amount you have paid us in the 12 months before the claim. We are not liable for indirect loss, lost profit, lost data caused by third parties, or consequences of content you have supplied. Nothing here limits liability that cannot be limited by law.

11. Law and disputes

Danish law applies. Disputes go to the courts of Aarhus, Denmark, unless mandatory consumer law says otherwise.

12. Changes to these terms

We may update these terms. Material changes are announced by e-mail at least 30 days before they apply. Continuing to use the service after that date means you accept the updated terms.
